1. Scope

These Terms of Use (the “Terms”) govern your use of educhain.bg (the “Platform”) operated by [Controller/Anakinis EOOD] (“EduChain”, “we”).

The Platform connects parents, teachers and educational organizations via a curated directory and profile pages. Unless expressly stated otherwise, EduChain is not a party to any contract between users and third‑party organizations and does not warrant the quality, accuracy or availability of third‑party offerings.

2. Acceptance

By accessing or registering, you agree to these Terms and our Privacy & Cookies Policies. If you do not agree, do not use the Platform.

3. Accounts

Accounts exist for: (a) parents, (b) teachers, (c) organizations.

You must provide accurate information and keep your credentials secure.

If you are under 14, you may only use the Platform with verifiable parental consent.

4. Acceptable Use

No unlawful content, IP infringements, misleading information, spam/malware, attempts to breach security, or unauthorized collection of others’ data.

Platform content is protected.

User content: by posting you grant EduChain a non‑exclusive, royalty‑free, worldwide license to use/display it for Platform purposes. You warrant you have the necessary rights.

6. Third‑Party Services & Offers

Listings and offers are published by the respective organizations, which remain solely responsible for compliance and performance.

If the Platform enables payments/subscriptions, Special Terms in Appendix A apply (fill in if applicable). Специални условия в раздел [Приложение A] (попълнете при необходимост).

7. Termination

We may suspend or terminate access for violations of these Terms or for security and legal reasons.

8. Disclaimer

The Platform is provided “as is”. We do not guarantee error‑free, uninterrupted operation or fitness for a particular purpose.

9. Liability

To the extent permitted by law, EduChain shall not be liable for indirect/consequential damages, losses arising from contracts between users and third parties, data loss or loss of profits. Nothing excludes liability for wilful misconduct or gross negligence.

10. Governing Law & Jurisdiction

Bulgarian law applies. Courts in Sofia, Bulgaria have exclusive jurisdiction.

11. Changes

We may update these Terms; material changes will be notified on the Platform and take effect upon publication or on the stated date.

6) PRIVACY POLICY (EN)

1. Controller

2. Data We Process

Account data: username, (hashed) password, email, phone, role, organization profile details (name, description, addresses, contacts).
Operational data: settings, communications via forms, access/event logs, cookie consent state.
Technical data: IP, device/browser identifiers, cookies and similar technologies.
Marketing data (if applicable): newsletter subscriptions, preferences.

3. Sources

Data comes directly from you (registration/forms) and automatically via cookies/logs. For organization profiles – from authorized representatives.

4. Purposes & Legal Bases (Art. 6 GDPR)

Contract performance: account creation/maintenance; listing and discovery features.
Legitimate interests: platform improvement; abuse prevention; protection of rights and interests; statistics with minimized data.
Legal obligations: accounting/tax (where paid services exist); responding to lawful requests.
Consent: marketing communications; non‑essential cookies; publishing images/testimonials where required.

5. Children

For children under 14, we process personal data only with valid parental/guardian consent and reasonable verification. The Platform is not intended for unsupervised registration by children.

6. Recipients & Processors

We use contracted processors (Art. 28 GDPR), e.g., hosting, email delivery, analytics, consent management. Category‑based lists are available upon request. Data may be disclosed to authorities as required by law.

7. International Transfers

Where data is transferred outside the EEA, we implement appropriate safeguards (e.g., Standard Contractual Clauses plus supplementary measures). Details available upon request.

8. Retention

Account data: for the lifetime of the account and [X] months/years thereafter.
Cookie consent records: up to [6–12 months] or per CMP settings.
Accounting records (if payments): 10 years under Bulgarian law.

9. Your Rights

We apply technical and organizational measures proportionate to risk – encryption in transit, access controls, logging, data minimization, etc.

We do not make decisions solely based on automated processing that produce legal or similarly significant effects, unless we inform you otherwise.

Necessary – secure login, sessions, consent preference storage.
Functional – preferences, enhanced features (optional).

3. Consent Management

A Consent Management Platform (CMP) on the site lets you accept/decline categories and change your choices at any time via the “Cookie settings” link/button. We do not activate non‑essential cookies without your consent.
